misclassified as salaried employees
performing management duties when in reality
they did little to no managerial tasks.
Rather they spent the greater percentage of
their day doing the same tasks that hourly
employees would collect overtime for.

Marshall's worked extremely long hours yet
were not paid overtime. The classification
of the Assistant Managers as exempt from
overtime wages has very often been
determined to violate the law and
classifying Assistant managers as exempt
from overtime pay can be a violation of fair
labor practices.
