$1.4 Million In Back Wages Due To Employees Of Plumbing And Heating Contractors
Four Long Island plumbing and heating
contractors are in hot water with the
Department of Labor after more than 300 past
and current employees filed a grievance
against them. The contractors engaged in
routine behavior that violated New York and
federal labor laws that shorted their
employees compensation by millions of
dollars. So far, the lawsuit has recovered
$1.4 million in unpaid wages and fines for
the employees cheated from receiving the
wages they earned.
Most of the unpaid wages were from years of
systematically depriving employees of
overtime. The contractors only paid the
employees straight time instead of the time
and a half for
overtime
that is required by New York and Federal
law. This is common in the world of manual
labor. Contractors exploit employees and
often get away with it because too few
employees assert their rights and hire an
experienced New York City
employee rights attorney
to recover the money they have earned.
The majority of the
wage theft
victims in this case were misclassified as
independent contractors by their employers.
Independent contractors are not required to
be paid overtime. Relatively few people in
the workforce count as independent
contractors. Essentially, if someone is
routinely telling you what to do and how to
do it, you probably are not an independent
contractor.
The victims in this case probably did not
recover the full amount of damages that they
were owed because they waited too long to
assert their rights. Between the statute of
limitations and the loss of evidence, the
amount the wage theft victims were able to
recover was reduced. If you believe you are
